六、項目背景

VI. Project Background

2014年12月，國務院批准設立中國（廣東）自由貿易試驗區，明確了自貿區南沙新區片區將建設成為以生產性服務業為主導的現代產業新高地和具有世界先進水平的綜合服務樞紐；2015年11月，國務院批覆珠三角國家自主創新示範區；2016年8月，廣州市委十屆九次全會提出要“加快建設廣州南沙新區城市副中心”；2017年1月，省委主要領導在省十二屆人大五次會議中，提出要將自貿區南沙新區片區建設成為高水平對外開放門戶樞紐，著力打造區域綜合交通樞紐，形成粵港澳大灣區協同發展。南沙將逐步由珠三角地理幾何中心向對外開放中心、經濟中心轉變。

亭角地區是進入自貿區南沙新區片區和城市中心區的門戶，毗鄰蕉門河中心區區塊和明珠灣起步區區塊，未來將以商業、居住、文化功能為主。豐富的濱水岸線、完好的山水生態稟賦、充足的空間資源貯備、優越的對外交通區位條件，使得本地區勢必成為體現自貿區門戶和廣州城市副中心形象的區域。本項目的開展將積極帶動和影響該區域的城市化進程和城市環境品質提升。

本次國際競賽由廣州南沙開發區國土資源和規劃局（以下簡稱“主辦單位”）牽頭組織開展，由廣州南沙開發區規劃研究中心（以下簡稱“承辦單位”）負責具體工作組織安排。

七、設計範圍及總體要求

VII. Design Scope and General Requirements

項目設計範圍位於南沙新區黃閣鎮、東湧鎮交界處，西起東湧鎮萬榮路，東至鳳凰大道，北靠大山乸自然山體，南臨蕉門水道。總體設計範圍約13.2平方公里，其中核心區設計範圍約3.8平方公里（詳見附件）。該地區是進入自貿試驗區南沙片區和城市中心區的城市門戶，承載著全面展示南沙獨具山水特色和嶺南風格城市形象的功能。

期望通過本次競賽為城市空間的開發提供新的開發思路和方法借鑑，為公眾營造開放、趣味、多樣、人性化的公共開敞空間，將該地區建設成“開發綜合型、環境友好型、服務創新型”的自貿區南沙新區片區門戶地區，從而帶動周邊區域的城市建設品質提升。

說明：本項目的《競賽技術文件》正式稿於組織競賽技術文件發佈與答疑會議時公佈。

八、競賽報名方式

VIII. Registration

（一）參賽單位報名條件

(I) Requirements for registration

1、參賽單位須具有獨立法人資格，具備建設部頒發的有效的城市規劃設計乙級（或以上）資質和建築設計乙級（或以上）資質。法定代表人為同一人的兩個及兩個以上法人，母公司、全資子公司或存在控股管理關係的不同單位，都不得同時報名參賽；

2、參賽單位自2010年1月1日至今具有類似項目的設計經驗與相關業績（以合同為準）。

2. The competitors must have design experiences of the similar project and relevant project reference (as per signed contract) since January 1, 2010;

3、本次競賽接受聯合體報名，歡迎境外機構參與，鼓勵境內境外參賽人組成聯合體報名，聯合體報名時須提交《聯合體協議書》並在協議裡明確聯合體的主體單位（詳見附件三格式10），該主體單位必須滿足上述第1點要求。

說明：1）聯合體成員個數不得超過2家（含2家），聯合體各方不得再以自己名義單獨參賽或與其他參賽人組成新的聯合體參與本競賽。

（二）報名方法

(II) Method of registration

1、有意參與的參賽單位應於報名截止時間3天前（即2017年4月23 日前）將填好的《資格預審調查表》（詳見本公告《附件三》格式1，簽字並加蓋公章）傳真並電郵到組織代理單位；

2、所有報名文件必須在報名截止時間前以書面形式送達或郵寄至組織代理單位，以組織代理單位接收到報名文件時間為準，逾期抵達的報名文件概不受理。

（三）報名時間

(III) Registration time

1、報名時間：2017年4月6日至4月26日（每天上午9:30時至下午5:00時止，北京時間，法定節假日除外）。

2、報名地點：廣東省機電設備招標有限公司（廣東省廣州市環市中路316號金鷹大廈10樓1011室））；

3、報名截止時間為北京時間2017年4月26日下午17:00時整（以組織代理單位接收書面報名文件時間為準）。

（四）競賽報名文件（以下資料以A4格式按順序編排，並裝訂成冊，雙面打印，一式一份）

1、《資格預審調查表》（正本，簽字並加蓋公章）。

2、參賽單位名稱及資質說明（提供資質證書複印件）。

3、參賽單位簡介。

4、法定代表人證明書（原件）、法定代表人授權委託書（原件）（適用於境內參賽人或聯合體中的境內參賽人）；單位負責人證明書（原件）、單位負責人授權書（原件）（適用於境外參賽人或聯合體中的境外參賽人）；被授權人有效身份證明覆印件。

5、參賽單位主要業績。

6、參賽單位同類項目的設計經驗與相關業績（自2010年1月1日至今）。

7、擬投入本次競賽的項目主創設計師及各專業負責人的組成名單。

8、擬投入本競賽人員的專業經驗及業績。

9、正式報名確認函。

10、聯合體協議書（僅適用於以聯合體形式報名的參賽單位）。

11、參賽單位認為有必要的其他資料。

說明：

1）以上資料複印件除註明外，每頁均需按要求加蓋公章或被有效簽署人簽字或蓋章，格式見附件三《資格審查報名文件格式》。

2）所有競賽報名文件必須在報名截止時間前以書面形式【送達或郵寄】至組織代理單位，以組織代理單位接收到報名文件時間為準，逾期抵達的報名文件概不受理。

3）關於境外參賽人報名文件單位蓋章的說明：報名文件要求單位蓋章之處，如境外參賽人所在企業無印章的，可以單位負責人或經其正式授權的代表簽字為準。

九、競賽方式

IX. Forms of the Competition

1、參賽單位的選擇

1. Selection of competitors

本次競賽活動採用公開報名的方式，通過在網站發佈報名公告，公開接受國內外參賽單位（含聯合體）報名，由主辦單位組織資格審查委員會，根據報名參賽單位的設計資質、綜合實力、同類項目設計經驗及獲獎情況、主創設計師在行業內的聲望、設計團隊的配備等因素，以及必要的考察調研，擇優選取6家參賽單位（含聯合體）正式參與本次國際競賽，其餘未受正式邀請的參賽單位報送的競賽方案將不被受理（《擇優評審細則》詳見本公告《附件二》）。

本項目競賽單位選擇結果將於2017年5月12日（暫定）前進行公佈。

The selection result is scheduled to be announced by May 12, 2017 (TBD).

2、競賽技術文件發佈

2. Briefing of the Technical Document

本項目正式競賽技術文件發佈會議將在廣州市南沙區舉行，時間（暫定）為2017年6月 5日，具體以邀請函中的地點和時間為準。

The official briefing meeting of the Technical Document will be held in Nansha District, Guangzhou on June 5, 2017 (TBD). The place and time will be finalized in the Invitation Letter.

3、成果提交時間

3. Submission deadline of deliverables

成果提交截止時間暫定為2017年8月5日17：00時前。所有參賽單位須在截止時間前將最終設計成果文件及模型提交到廣州南沙開發區國土資源和規劃局，以實際收到日期為準。

4、成果評審方式

4. Deliverables evaluation

本次競賽成果評審包括方案符合性審查和方案評審兩個階段。評審委員會將首先對所有競賽文件進行符合性審查，確定競賽文件的有效性。無效方案不得進入方案評審。

評審委員會將對有效設計方案進行方案評審，在認真研究競賽技術文件、充分討論比較的基礎上，以投票方式為選出3個優勝方案。

評審工作結束後，由評審委員會編寫書面評審意見，由全體評委簽名後，交競賽委員會。

本項目的競賽評審結果將於競賽成果評審會後6個工作日左右前進行公佈。

5、競賽成本補償及獎金

3個優勝方案的對應的參賽單位各獲得￥1500,000元（人民幣壹佰伍拾萬元整，含稅）的設計成本費及獎金，其餘競賽機構（含聯合體）各獲得￥800,000元（人民幣捌拾萬元整，含稅）的設計成本費作為工作補償。設計成本費及獎金在評審結果公佈後30日內一次性支付。

6、深化設計單位的選定

6. Selection of competitor for design detailing

Afterwards, the Evaluation Committee will prepare the written comments and submit them to the Competition Committee with the signature of all members.

競賽委員會通過商務談判在三家優勝單位中選定深化單位，該單位將獲得廣州南沙新區亭角地區城市設計的深化設計權，深化設計單位負責按評審意見和競賽委員會的要求完成深化設計工作。

深化單位將獲深化設計費用￥2,780,000元(人民幣貳佰柒拾捌萬元整，含稅），另簽訂深化設計補充合同。

The competitor will be offered RMB 2,780,000 (RMB Two Million Seven Hundred and Eighty Thousand Only, tax included) for design detailing, and sign a supplementary agreement on design detailing.

說明：1）競賽成果經評審委員會評定為無效方案的參賽單位（含聯合體），將不能獲得競賽成本補償。所有競賽成果及版權歸主辦單位所有。若方案未能達到相應要求，優勝方案可以減少或空缺；

2）參賽單位所獲得的成本補償及獎金均以人民幣在境內支付各競賽機構，境外設計單位若無法使用本單位帳戶收取人民幣，可授權境內其他單位代收款項，主辦方不支付相關手續費用和稅金等費用，聯合體的向聯合體主體單位計發設計成本補償及獎金；

2) The compensation for costs and bonus will be paid to the competitors in RMB in China. If the overseas competitors cannot receive proceeds in RMB with their bank accounts, they may engage local agents to collect the proceeds, and any fees and taxes thus incurred shall not be borne by the Sponsor. If the competitor is a consortium, the compensation for costs and bonus will be paid to the leading firm.

3）以上成本補償費及獎金的稅金由參賽單位自理；參賽單位人員的往來差旅費用和設計費自理。

3) The tax on the above-mentioned compensation for costs and bonus shall be borne by the competitors, so are their travel expenses and design expenses.

十、競賽保證金

X. Security

為確保本次國際競賽的圓滿進行，正式被邀請參加的競賽機構（含聯合體）確認參加時，應向競賽組織代理單位交納競賽保證金￥50,000元（人民幣伍萬元整）。

To ensure smooth implementation of the Competition, the competitors (including consortiums) officially invited, when confirming to participate in the Competition, shall pay a security of RMB 50,000.00 (RMB Fifty Thousand Only) to the Organizing Agent.

競賽保證金將在方案評審結束後2周內原額退回付款賬戶（不計利息）。若未按規定報送競賽成果的競賽機構，其保證金不予退還。

The security will be returned to the accounts of payment within 2 weeks after conclusion of the proposal evaluation in full amount (without interest). However, the security will not be returned to the competitors that failed to submit the deliverables as required.

未按要求提交保證金的競賽機構將視為自動放棄參與競賽的資格。

If the competitor fails to pay the security as required, it will be deemed as waiver of participation in the Competition.

十一、其他

XI. Others

1、競賽機構按上述規定提供的所有材料均須是簡體中文，外文版材料須有對照的中文譯本，當同一內容的中文與外文發生歧義時，以中文為準。

1. All materials submitted by the competitors as per the above-mentioned rules must be prepared in simplified Chinese. For those in foreign languages, corresponding Chinese translation should be provided. In case of any discrepancy between the contents in the two languages, the Chinese version shall prevail.

2、主辦單位在按規定向競賽機構支付獎金及設計成本費後，參加競賽的成果署名權歸競賽機構所有，知識產權及版權歸主辦單位所有。

2. After the payment of compensation for costs and bonus, the competitors shall have right of authorship of the deliverables, while the Sponsor has the intellectual property right and copyright.

3、競賽方案成果應由參加競賽的機構原創。若因方案涉及第三方知識產權引起法律糾紛的，競賽機構須自行承擔一切責任和後果。

3. The deliverables should be the original work of the competitors. In case of any legal disputes caused by involving a third-party IP right, the competitors must bear any and all liabilities and consequences thus incurred.

4、因競賽機構侵犯他人知識產權給主辦單位或第三方帶來的損失，競賽機構須承擔全部賠償和法律責任。

4. In case of any loss caused to the Sponsor or any third party by the competitor’s IP infringement, the competitor in question must bear all the compensation and legal liabilities.

5、主辦單位不知道競賽機構侵犯他人知識產權，使用其送交的成果給第三方帶來的損失，由競賽機構承擔全部賠償和法律責任。

5. In case of any loss caused to any third party by the Sponsor using the deliverables without the awareness of the competitor’s IP infringement, the competitor in question should bear all the compensation and legal liabilities.

6、競賽機構從組織代理單位獲得的文件資料應妥善保管，不得洩露，也不得用於本次競賽活動以外的任何場合。競賽機構須承擔因文件資料洩露等情況所帶來的損失賠償責任和法律責任。

6. The competitors should safekeep the documents obtained from the Organizing Agent. Such documents must not be disclosed or used in any other occasions except the Competition; otherwise, the competitors must bear any loss and legal liabilities thus incurred.

7、本次競賽及相關的一切文件適用的法律為中華人民共和國法律。本次報名和競賽將在公平、公正、公開的原則下進行。如有糾紛，將按中國法律、法規，通過友好協商或仲裁程序解決。

7. The laws of the People’s Republic of China shall be applicable to this international Competition and all documents in connection with it. The registration and Competition will be carried out in line with the principles of fairness, justness and openness. Disputes (if any) will be settled through friendly consultation or arbitration procedures as per the Chinese laws and regulations.

8、本次競賽報名公告與正式發佈的《競賽技術文件》有不符之處，以正式發佈的《競賽技術文件》為準。

8. In case of any discrepancy between this Announcement and the officially issued Technical Document of the Competition, the latter shall prevail.

9、本國際競賽項目的報名公告英文版與中文版不一致之處，均以中文版的報名公告為準。

9. In case of any discrepancy between the Announcement in English and Chinese, the latter shall prevail.

10、所有報名文件概不退還。
